BP OIL SPILL COMPENSATION FUND.
BP and the Obama Administration announced with much fanfare a fund that will be administered by Kenneth Feinburg, a lawyer who oversaw a similar fund for victims of the Sept. 11 terrorist attacks. There are specific claim forms that need to be submitted to the administrators or BP to access the fund. Many individuals and business owners may want to assist their claim directly with BP. When filing a claim with the BP Oil Spill Compensation Fund, consider the following:
As with all legal claims, the claimant has the burden of proving the legitimacy of all aspects of the claim;
Utilize appraisers, accountants, and other professionals on complex claims [Note: Currently, BP has not agreed to reimburse claimants for professional fees associated with a claim];
Loss of income and loss of business revenue must be supported by historical records and tax returns – you may consider amending or filing tax returns for previous years before submitting a claim; and
Retain local attorneys and law firms to assist with your claim.
